Can i use warranty because of sunken button?

I got my HTC Inspire about 10 days ago and uts great but my power button is sunken in so it makes its rather hard to press it.the cellphone still looks new , i was wondering if ibcsn use the thirty day warranty to exchange to a new HTC Inspire,thanks
